Welcome to Sellvivor, operated by Soft Construct Limited (hereinafter also referred to as “we”, “us”, or “our”), a digital B2B platform that connects certified sellers (hereinafter referred to as the “Sellers”) offering business products and services with buyers (hereinafter referred to as the “Buyers”) seeking reliable business solutions.

These Terms and Conditions for Buyers (hereinafter referred to as the “Terms”) govern your access to and use of the Sellvivor application and related services (collectively, the “Platform” or “Application”) in your capacity as a Buyer.

By accessing or using Sellvivor, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree with these Terms, you must not use the Platform.

To use Sellvivor, you must be at least 18 years old and capable of entering into legally binding contracts. By creating an account, you represent and warrant that you meet this eligibility requirement.

We do not knowingly allow individuals under 18 to register or use the Platform. If we become aware that a minor has created an account, we will promptly remove it.

To access certain features of the Platform, you must create an account by providing your full name, email address, and phone number, or by logging in through one of the available login options.

You are responsible for:

• maintaining the confidentiality of your login credentials;
• all activities that occur under your account; and
• ensuring that your account information remains accurate and up to date.

You must not share your account with others or use another person’s account. If you suspect unauthorized use, notify us immediately.

Sellvivor is a B2B discovery and networking platform that allows Buyers to:

• browse a catalog of certified Sellers and their product or service offerings;
• view informative videos and educational content created by Sellers; and
• connect directly with Sellers to discuss and potentially purchase business solutions.

Sellvivor does not act as a party to any transaction between Buyers and Sellers. Any contract or purchase agreement is concluded directly between you and the Seller.

When using the Platform, you agree to:

• use it solely for lawful business purposes;
• provide accurate information when creating or updating your account;
• engage respectfully and professionally with Sellers and other users;
• not attempt to interfere with the Platform’s operation or security; and
• comply with all applicable laws and regulations when making business decisions.

You acknowledge that Sellvivor does not endorse, guarantee, or verify the performance or quality of any Seller or offering listed on the Platform.

Sellvivor may include links, embedded content, or integrations with third-party services (such as analytics or communication providers). If you use any third-party login option (such as a social or single sign-on service), the terms and privacy policies of that third-party provider will also apply. We are not responsible for the content, functionality, or data handling practices of third-party services.

All rights, titles, and interests in and to the Platform, including its content, design, trademarks, and technology, belong to Sellvivor or its licensors. You may not reproduce, distribute, or modify any Platform materials without our prior written consent. You may, however, access and view Seller content (including videos and product descriptions) solely for legitimate business evaluation purposes.

Your personal data is collected and processed in accordance with our Privacy Policy, available within the app and on our official website. We collect limited personal information (such as your name, email, and login data) to provide platform functionality, facilitate communication, and improve the user experience. We do not sell or rent your data to third parties. By using the Platform, you acknowledge that you have read and understood our Privacy Policy.

By using Sellvivor, you consent to receive in-app notifications, emails, or messages related to:

• account activity and updates;
• responses from Sellers;
• system and policy notifications.

You may opt out of non-essential marketing communications at any time.

The Platform is provided on an “as is” and “as available” basis. Sellvivor makes no representations or warranties regarding the accuracy, reliability, or completeness of Seller content; the outcome or success of any transaction with a Seller; uninterrupted or error-free operation of the Platform. You are solely responsible for verifying the authenticity, suitability, and quality of any Seller or offering before entering into any agreement.

To the fullest extent permitted by law, Sellvivor and its affiliates shall not be liable for any indirect, incidental, or consequential damages; loss of data, profits, or business opportunities; or unauthorized access to or alteration of your information. Our total liability, if any, shall not exceed the total amount (if any) paid by you to Sellvivor for use of the Platform during the six months preceding the claim.

You may delete your account at any time via your account settings. We may suspend or terminate your access if you breach these Terms; misuse the Platform; or engage in illegal or unethical activity. Upon termination, your personal data will be deleted in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of Malta. Any dispute shall be resolved through good-faith negotiations. If not resolved, the dispute shall be submitted to the competent courts of the above jurisdiction.

We may update these Terms from time to time at our sole discretion. The most current version of the Terms will always be available within the Application, and the “Last updated” date at the top of this document will reflect the effective date of the latest changes. Your continued use of the Platform after any modification constitutes your acceptance of the revised Terms.
